Americans, Germans, and War Crimes Justice:
Law, Memory, and "The Good War"

During World War II, both Americans and Germans committed war crimes, but the ways in which the U.S. Army dealt with crimes committed by their own soldiers were drastically different from its treatment of German atrocities. In fact, by the standards the U.S. Army used to try enemy commanders for war crimes, General George Patton could have been prosecuted as a war criminal.

World War II involved an unprecedented example of state-directed and ideologically motivated genocide---the Holocaust. Beyond this horrific, premeditated war crime perpetrated on a colossal scale, there were also isolated and spontaneous war crimes committed by both German and U.S. forces.
The book is focused on two World War II atrocities---one committed by Germans and the other by Americans. The author carefully examines how the U.S. Army treated each crime and gives accounts of the atrocities from both German and American perspectives. The two events are contextualized within multiple frameworks: the international law of war, the phenomenon of war criminality in World War II, and German and American collective memories of World War II. Americans, Germans, and War Crimes Justice: Law, Memory, and "The Good War" provides a fresh and comprehensive perspective on the complex and sensitive subject of World War II war crimes and justice.

Whereas the past few years have repeatedly been referred to as the “era of biotechnology”, most recently the impression has emerged that at least the same degree of attention is being paid to the latest developments in the field of neurosciences. It has now become nearly impossible to maintain an overview of the number of research projects dealing with the functionality of the brain – for example concerning its organizational structure – or projects dealing with the topics of legal responsibility, brain-computer interface applications, neuromarketing, lie detection or mind reading. These procedures are connected to a number of legal questions concerning the framework conditions of research projects as well as the right approach to the findings generated. Given the primary importance of the topic for the latest developments, it is essential to compare the different legal systems and strategies that they offer for dealing with these legal implications. Therefore, the book International Neurolaw – A Comparative Analysis contains several country reports from around the world, as well as those of international organizations such as UNESCO, in order to show the different legal approaches to the topic and possible interactions.

Secondo le proiezioni dell'Istat, nel 2050 circa un terzo della popolazione con meno di 24 anni avrà un genitore straniero. I figli dell'immigrazione sono importanti, non solo sotto il profilo quantitativo, ma anche perché contribuiranno a determinare il livello e la qualità del capitale umano di cui l'economia italiana avrà bisogno per competere con gli altri paesi. Immigrati: servizi uguali o diversi?

Sebbene con l'evolversi del fenomeno migratorio l'opzione di servizi di welfare rivolti indistintamente a tutta la popolazione sia prevalsa su quella di servizi dedicati agli immigrati, ce da chiedersi se sia davvero la soluzione migliore. Il volume cerca di rispondere a questo interrogativo attraverso un'indagine comparata che analizza alcuni servizi per l'inserimento lavorativo, abitativo e scolastico nelle province di Torino e Cuneo. Non abbiamo trovato una risposta, ma interessanti dati empirici. A determinare il grado di orientamento dei servizi nei confronti degli immigrati pare essere una vasta gamma di fattori endogeni ed esogeni. La valutazione dei risultati in termini di integrazione suggerirebbe di orientare la popolazione immigrata verso i servizi generali, predisponendo però al loro interno dispositivi a essa dedicati. Tuttavia, anche la semplice presenza di azioni riservate agli immigrati tende a generare rimostranze tra gli autoctoni alzando il livello di conflitto. Resta quindi il dubbio su quale sia la soluzione ottimale. Quel che è certo è invece la difficoltà dei servizi a massimizzare contemporaneamente il benessere degli immigrati e dei nazionali, l'interazione non conflittuale tra stranieri e autoctoni, l'efficacia e l'efficienza rispetto al sistema di welfare in cui sono inseriti.

Il principale interrogativo che si pone questo volume è se sia possibile sviluppare un valido modello d'integrazione per le nuove minoranze originate dall'immigrazione che riesca a conciliare unità e diversità. Cercare di conciliare le rivendicazioni delle minoranze significa, infatti, individuare un giusto equilibrio tra unità e separazione, coesione e rispetto della diversità. Qualora si opti unicamente per l'unità, il rischio è l'assimilazione e la scomparsa della minoranza come comunità distinta; qualora si scelga esclusivamente la diversità, il risultato può essere la 'ghettizzazione' culturale di un gruppo minoritario e la sua conseguente separazione ed emarginazione dalla società. Il rapporto tra diversità e coesione sociale solleva innumerevoli dubbi. Fino a che punto la diversità è compatibile con il mantenimento di una comunità stabile e coesa? È possibile creare una società in grado di conciliare e rispettare, non solo di tollerare, la diversità? Come sviluppare la capacità di rendere la differenza una risorsa anziché temerla come una minaccia? Il presente volume si pone l'obiettivo di dimostrare che è possibile affrontare questi temi associando due campi di ricerca: minoranze e migrazione.

Gender and Islam in Africa examines ways in which women in Africa are interpreting traditional Islamic concepts in order to empower themselves and their societies. African women, it argues, have promoted the ideals and practices of equality, human rights, and democracy within the framework of Islamic thought, challenging conventional conceptualizations of the religion as gender-constricted and patriarchal.
The contributors come from the fields of history, anthropology, linguistics, gender studies, religious studies, and law. Can wrongs be righted? Can we make up for our misdeeds, or does the impossibility of changing the past mean that we remain permanently guilty? While atonement is traditionally considered a theological topic, Making Amends uses the resources of secular moral philosophy to explore the possibility of correcting the wrongs we do to one another.
Philosophers generally approach the problem of past wrongdoing from the point of view of either a judge or a victim. They assume that wrongdoing can only be resolved through punishment or forgiveness. But this book explores the responses that wrongdoers can and should make to their own misdeeds, responses such as apology, repentance, reparations, and self-punishment. Making Amends explores the possibility of atonement in a broad spectrum of contexts--from cases of relatively minor wrongs in personal relationships, to crimes, to the historical injustices of our political and religious communities. Christine M. Korsgaard presents an account of the foundation of practical reason and moral obligation. Moral philosophy aspires to understand the fact that human actions, unlike the actions of the other animals, can be morally good or bad, right or wrong. Few moral philosophers, however, have exploited the idea that actions might be morally good or bad in virtue of being good or bad of their kind - good or bad as actions. Just as we need to know that it is the function of the heart to pump blood to know that a good heart is one that pumps blood successfully, so we need to know what the function of an action is in order to know what counts as a good or bad action. Drawing on the work of Plato, Aristotle, and Kant, Korsgaard proposes that the function of an action is to constitute the agency and therefore the identity of the person who does it. As rational beings, we are aware of, and therefore in control of, the principles that govern our actions. A good action is one that constitutes its agent as the autonomous and efficacious cause of her own movements. These properties correspond, respectively, to Kant's two imperatives of practical reason. Conformity to the categorical imperative renders us autonomous, and conformity to the hypothetical imperative renders us efficacious. And in determining what effects we will have in the world, we are at the same time determining our own identities. Korsgaard develops a theory of action and of interaction, and of the form interaction must take if we are to have the integrity that, she argues, is essential for agency. On the basis of that theory, she argues that only morally good action can serve the function of action, which is self-constitution.

Much of what humans know we cannot say. And much of what we do we cannot describe. For example, how do we know how to ride a bike when we can’t explain how we do it? Abilities like this were called “tacit knowledge” by physical chemist and philosopher Michael Polanyi, but here Harry Collins analyzes the term, and the behavior, in much greater detail, often departing from Polanyi’s treatment.
In Tacit and Explicit Knowledge, Collins develops a common conceptual language to bridge the concept’s disparate domains by explaining explicit knowledge and classifying tacit knowledge. Thus, bicycle riding consists of some somatic tacit knowledge and some collective tacit knowledge, such as the knowledge that allows us to navigate in traffic. The intermixing of the three kinds of tacit knowledge has led to confusion in the past; Collins’s book will at last unravel the complexities of the idea.

To be responsible for their acts, agents must both perform those acts voluntarily and in some sense know what they are doing. Of these requirements, the voluntariness condition has been much discussed, but the epistemic condition has received far less attention. In Who Knew? George Sher seeks to rectify that imbalance. The book is divided in two halves, the first of which criticizes a popular but inadequate way of understanding the epistemic condition, while the second seeks to develop a more adequate alternative. It is often assumed that agents are responsible only for what they are aware of doing or bringing about--that their responsibility extends only as far as the searchlight of their consciousness. The book criticizes this "searchlight view" on two main grounds: first, that it is inconsistent with our attributions of responsibility to a broad range of agents who should but do not realize that they are acting wrongly or foolishly, and, second, that the view is not independently defensible. The book's positive view construes the crucial relation between an agent and his failure to recognize the wrongness or foolishness of what he is doing in causal terms: the agent is responsible when, and because, his failure to respond to his reasons for believing that he is acting wrongly or foolishly has its origins in the same constitutive psychology that generally does render him reason-responsive.

A major theme of Buchanan's book is the need to combine the philosopher's normative analysis with the political scientist's focus on institutions. Instead of thinking first about norms and then about institutions, if at all, only as mechanisms for implementing norms, it is necessary to consider alternative "packages" consisting of norms and institutions. Whether a particular norm is acceptable can depend upon the institutional context in which it is supposed to be instantiated, and whether a particular institutional arrangement is acceptable can depend on whether it realizes norms of legitimacy or of justice, or at least has a tendency to foster the conditions under which such norms can be realized. In order to evaluate institutions it is necessary not only to consider how well they implement norms that are now considered valid but also their capacity for fostering the epistemic conditions under which norms can be contested, revised, and improved.
